1. Agreement to Terms
By using Ember (HeyEmber.ai) ("Service"), operated by LittleRedCode Pte Ltd ("we"), you agree to these Terms of Service. If you disagree, do not use the Service.
2. Description of Service
Ember is an AI-powered relationship conversation platform where both partners have private conversations with an AI conversation partner. The AI uses context from both partners to provide guidance while maintaining privacy between partners.
3. Important Disclaimers
Ember is not a licensed therapist, counselor, or mental health provider. Ember is an AI assistant providing general relationship guidance. The Service does not create a therapist-client relationship.
Seek professional help if you or your partner are experiencing mental health crises, domestic violence, or serious relationship distress requiring professional intervention. In emergencies, contact local emergency services.
AI limitations: Ember may produce inaccurate or unhelpful responses. You are responsible for evaluating any information provided.
4. Eligibility
You must be at least 18 years old and have the legal capacity to enter into these Terms.
5. Your Account
You are responsible for maintaining the security of your account and for all activities under it. Each person may only have one account. When inviting a partner, you represent you have their consent. You agree not to attempt to access your partner's account or conversations.
6. Privacy Between Partners
Your conversations with Ember are private. Your partner cannot view them, and Ember will never reveal what one partner shared to the other. You understand that Ember's responses may be informed by context from your partner that you cannot see.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to manipulate or exploit the AI system
- Use the Service to harm or harass another person
- Attempt to access another user's account or data
- Interfere with or disrupt the Service
8. Subscriptions and Payments
We offer free and paid subscription tiers. Paid subscriptions are billed on a recurring basis. You may cancel at any time; cancellation takes effect at the end of your billing period.
We may change prices with 30 days' notice. Refunds are at our sole discretion.
9. Intellectual Property
The Service and its content are owned by LittleRedCode Pte Ltd. You retain ownership of content you submit but grant us a license to use it to provide and improve the Service.
10. Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR S$100, WHICHEVER IS GREATER.
11. Indemnification
You agree to indemnify LittleRedCode Pte Ltd from any claims arising from your use of the Service or violation of these Terms.
12. Termination
You may terminate your account at any time. We may suspend or terminate your account for violation of these Terms. Upon termination, your right to use the Service ends.
13. Governing Law
These Terms are governed by the laws of Singapore. Disputes shall be resolved in the courts of Singapore.
14. Changes to Terms
We may modify these Terms at any time. Material changes will be notified via email or notice in the Service. Continued use constitutes acceptance.
